Nixzmary Brown was seven years old when she was murdered after years of torture and abuse. Nixzmary was kept bound, molested and beaten by her stepfather Cesar Rodriguez.  The final beating that claimed Nixzmary’s life, was over a cup of yogurt and a broken printer.  Rodriguez became irate when learning that is printer wasn’t working, one of the other children had mentioned it may have been Nixzmary who broke it. Then he discovered a cup of yogurt was missing. When he asked Santiago who had taken the yogurt, she also blamed Nixzmary. This sent Rodriguez into a murderous rage. 

 

On January 10, 2006, Rodriguez beat Nixzmary to death using his fists and a leather belt, which was covered in Nixmary’s DNA.  He drug Nixzmary to the bathroom while stripping her naked and began dowsing her with cold water.  Her mother Nixzaliz Santiago the one person who was supposed to keep her safe, sat by as Rodriguez slammed Nixzmary’s head into a bathtub and wet her with cold water.  Rodriguez then threw Nixzmary back into her prison of a room and walked away.  Nixzmary was unconscious and in respiratory distress for hours before her little body gave out.  No one attempted to do anything to help Nixzmary. Nixzmary spent the last moments of her life crumpled on the bare floor, beaten, alone, terrified, and moaning and groaning as she tried to gasp for air.  The last words the little girl was able to utter were “Mommy, mommy, mommy.”, but mommy never came.  As a matter of fact, no one even noticed Nixzmary had passed away until seven hours after her death. When her mother finally checked on her, she was already dead. Surrounded by rodents and filth in a dirty room. Nixzmary only weighed 36 pounds when she died, she was seven years old. In death, Nixzmary would finally escape the abuse she had suffered at the hands of her stepfather with the approval of her mother.

 

CPS received a complaint about the abuse of Nixzmary when she showed up to school with a black eye. An interview was conducted Nixzmary, her siblings and her stepfather were all interviewed though CPS was not able to get into the house to check things out. The case would stall right there. The CPS workers would be the first of many to fail Nixzmary Brown. Cesar Rodriguez had abused Nixzmary physically and sexually for weeks before the night that he killed her. Nixzmary was tied to a chair and beaten, she was sexually abused and when she was left in the dirty room, she was even forced to use a cat little box as a toilet. Cesar Rodriguez and Nixzaliz Santiago plead not guilty to the multiple felony charges against them. The charges included second degree murder as well as charges against Cesar for molesting Nixzmary and abusing the other five children in the home. Cesar Rodriguez was convicted of first degree manslaughter. For his part in the killing of Nixzmary he received a sentence of 29 years. Nixzaliz Santiago was acquitted of murder on October 17, 2008, she was, however, found guilty of manslaughter. Nixzaliz was sentence to a short term of 43 years in prison, she showed zero emotion as she was given her sentence.
