Nicole McKay admitted to intentionally consuming a controlled substance, and getting up in the middle of the night to feed her infant daughter Emma. McKay then fall asleep with the child. Tragically, Emma never made it back into the bassinet. McKay was awakened and asked where Emma was, seeing that only a partially consumed bottle of formula was in Emma’s bassinet. McKay moved the bassinet and found Emma on the floor dead suffocated on a pillow on the floor.

 

McKay had been charged with two counts of manslaughter and one count each of child neglect and child endangerment. McKay also pleaded guilty to a separate charge relating to her 21 month old son who had tested positive for meth, heroin and oxycodone. She was accused of leaving drug paraphernalia where the boy could reach it. She pleaded guilty to a charge of storing methamphetamine paraphernalia in the presence of a child. McKay spent 30 days in jail for the death of Emma.
