On the morning of September Matthew Kuzdzal, shot up on heroin and was later left alone to watch Nora Brooks five year old son Eain while she was running errands. Later in the day Kuzdzal got angry at Eain because Eain he had urinated on himself and wouldn't take a shower. So, Kuzdzal pushed Eain, he fell and struck his head on the bathtub, Eain was knocked out. Eain was taken to Women and Children's Hospital with a serious head injury, bruises were all over his body and there was evidence Eain had been sexually assaulted. Doctors at Women and Children’s Hospital said Eain’s body temperature was so low when he was brought there after Kuzdzal called 911 around 7:30 p.m. that he must have been injured hours earlier. Kuzdzal’s failure to seek immediate treatment showed a depraved indifference for Eain’s life. Eain died two days later on September 17, 2013 from the head injury, which fractured his skull.

 

Kuzdzal said Eain fell down the stairs while carrying laundry.However, the Medical Examiner testified that fatal injury given to Eain had required significant force and compared that force to a fall from a 20 story building. Eain’s multiple injuries including lacerations, bruises on his back and shoulders as well as abrasions on his hips as well as injuries in and around his rectum consistent with a penetrating trauma. Kuzdzal, admitted he lied to police and Brooks the night of the attack when he told them Eain had fallen down the basement stairs while carrying the laundry. He changed his story on September 18, 2013 during an interview with homicide detectives after being showed photos of Eain’s injuries. He told the detectives he become angry with Eain and shoved him toward the bathtub after Eain wet himself and refused to take a shower, causing him to fall and hit his head on the tub. He said he spent the next half hour trying to revive him, before texting Brooks at 7:25 p.m. to tell her that the boy had fallen and asking her what to do. He then called 911. Kuzdzal also admitted that he used heroin daily at the time and had shot up the morning that Eain was injured.

 

Kuzdzal was convicted of second degree murder and predatory sexual assault in the fatal beating of Eain Brooks. Kuzdzal was sentenced to 50 years to life in prison, the maximum sentence possible. Kuzdzal will be 77 before he’s even eligible for parole. Nora has not been charged but, how much did Nora know about the abuse? Nora knew that Eain was being abused. According to Eain's fatality report, Nora and Kuzdzal repeatedly denied that they abused Eain. They were talking to CPS caseworkers who went to Eain's home to investigate reports of abuse. Nora and Kuzdzal also said Eain's injuries were accidental. One example in the report says: "The child showed up at school in February 2013, with a burn on his face from an ice pack because the mother's boyfriend had given him a 'swirly' in the toilet." Eain's mother claims the ice pack leaked chemicals, burning Eain's face."The day Eain died was the day that Nora stopped being my daughter in my heart," said Robin Hart, Eain Brooks' grandmother. Hart is Nora Brooks' mother. "I feel she should be held responsible," Hart said.
