Danieal Kelly was born to Andrea Kelly on January 3, 1992, she was the third child and had Cerebral Palsy. Cerebral Palsy left Danieal defenseless and totally dependent on her mother for every basic need she required. Andrea was a mother of nine children she had with five different men. She was pregnant with her tenth child when she was arrested.

 

Danieal lived a sad, short and painful life. Danieal spent the first four years of her life with her mother, brother and other family members in a cramped row house with no working toilet. Her hair was matted and in knots and her teeth were rotted out. Her maternal grandmother was so concerned she asked Daniel to take custody so he did. He eventually moved both kids to Arizona where they all lived with his girlfriend, Kathleen John.  While Danieal was in Arizona with her father, she thrived and grew into a beautiful, happy, confident little girl.  She learned to talk and feed herself.  She was enrolled in a special needs class where she flourished. A school report described her as an “active learner” and “one of the sweetest students ever enrolled in this program.”

 

It appeared that while living with her father, Danieal was being loved and cared for. Some news articles painted a picture of a dedicated father who only wanted the best for his children. The truth is though, this was not the case at all, he beat them with extension cords, left them at home alone and neglected them. Kathleen was Danieal’s only hope. She was the one that took an interest in Danieal and her brother, she was the one that enrolled them in programs.  When Daniel Kelly broke up with his girlfriend in 2001, he Danieal from school. This triggered a tragic set of event for Danieal.

 

Daniel asked the children’s grandmother to take custody however she became sick and couldn’t do it. In 2003, he the children and returned to Philadelphia where he asked his estranged wife and her other children to move in with him. Soon after, he moved out, abandoning the children leaving them in Andrea Kelly’s care. Daniel Kelly was well aware what deserting his daughter meant to her safety and welfare. He known the danger he put Danieal in. He just did not care, he never even bothered to visit his children again.

 

Instead of trying to get help taking care of Danieal. Andrea continued to live her life as if she didn’t have a care in the world, she was going to classes, entertaining and deiced it would be a grteat idea to locked Danieal in a dark room with no air circulation, where she layed helpless on a bed, unable to do anything for herself. Danieal never attended school, and Andrea failed to ever get her disabled daughter any medical attention even when it became apparent she needed it. Danieal’s brother begged his mother to call 911 many times, but instead of making the call she threatened him. She make him afraidl to make a call himself. It wasn’t until he told her that flies were covering Danieal’s body that Andrea finally called for help. Sadly, Danieal had been dead for hours before help arrived.

 

On August 4, 2006, police and paramedics arrived to the apartment and found Danieal curled up in a ball on a mattress, both Danieal r and the mattress were covered in feces. She had deep maggot filled bed sores found all over her body. Danieal was emaciated, malnourished and weighed only 42 pounds, the average weight of a 5 year old not a fourteen year old. Danieal was left, starving and festering in her own waste for such a long period of timte, hat her body left a permanent indentation and outline on the mattress. Danieal’s official cause of death was malnutrition and infection.

When Andrea was asked why she did this to her daughter, she stated that she did not give Danieal food or fluids because she figured if nothing went in, nothing would come out.  She didn’t want to touch her own or clean her disabled daughter. 

Andrea told police she was “embarrassed by Danieal”, and didn’t want to take her out in public. Andrea also told authorities that when family members and friends began to express concern for Danieal, shut them out, not allowing them to come around anymore. If friends and family would have spoken for Danieal when she could not, they could have save her life. This they will have to live with themselves knowing this.

 

Andrea Kelly plead guilty to the third degree murder charges and "agree" to serve 20 to 40 years in prison. Daniel Kelly was sentenced to two and a half to five years in prison. Caseworkers Mickal Kamuvaka and Dana Poindexter were both sentenced to two and half to five years for child endangerment and perjury. Kamuvaka is already serving a 17 year federal sentence for involuntary manslaughter, tampering with evidence, forgery and conspiracy.
